Welcome to EPIARX Diagnostics™ (“EPIARX,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, products, consultations, and services. Please read them carefully.

1. Scope of Our Services

EPIARX™ is a clinical diagnostics company that provides independent pathology services to individuals, families, healthcare providers, and legal professionals. Our services include:

1.1. Clinical and Forensic Autopsies

We provide full or partial private autopsies performed by licensed, board-certified pathologists. These may include a gross examination, a microscopic tissue analysis, and the coordination of toxicology testing. Our goal is to determine the most accurate cause and manner of death and issue a written pathology report.

1.2. Client Coordination

We coordinate logistics between families, funeral homes, and medical facilities to ensure respectful, timely handling of remains, specimens, and documentation.

1.3. Expert Consultations

We provide second-opinion reviews, case consultations, and diagnostic assessments for hospitals, attorneys, funeral homes, and families. These services are educational and diagnostic in nature and should not replace legal or primary medical decision-making.

1.4. Post-Mortem DNA Testing and Preservation (CircoGen™ by EPIARX)

We offer CircoGen™, a proprietary service by EPIARX™ for the post-mortem collection, stabilization, and preservation of DNA. Families and clinicians may choose to store DNA long-term for potential future analysis or order optional testing at the time of preservation.

1.5. Arts Memorial™ by EPIARX

Arts Memorial™ is a digital memorial and legacy planning service operated by EPIARX™. It enables families to create and preserve personalized tribute pages, share obituaries, and curate memory archives. This offering is designed to help honor loved ones and extend meaningful engagement during the grieving process. Use of this service is subject to additional content and moderation guidelines outlined in our platform terms.

1.6. Educational Resources

We publish educational content and offer downloadable guides to help clients make informed decisions around end-of-life, post-mortem testing, and family health. These are provided for general informational purposes only and do not constitute medical or legal advice.

In addition, EPIARX™ maintains a curated Resource Library featuring third-party links to trusted organizations, including but not limited to cancer trial databases, grief support networks, malpractice attorney directories, and funeral home selection tools. These external links are provided as a convenience to our users. EPIARX™ does not control or guarantee the accuracy, relevance, or completeness of the content found on these external sites and is not responsible for any third-party services or information.

Use of these resources is voluntary, and users should conduct their own due diligence before making decisions based on third-party content.

Important: Our services are not a substitute for emergency medical care, legal advice, or state-mandated forensic autopsies.

2. Eligibility to Use Our Services

You may access and use EPIARX™ services only if you meet all of the following criteria:

• You are 18 years of age or older.

• You are legally authorized to act on behalf of the deceased individual (e.g., next of kin, legal guardian, executor of estate, or holder of power of attorney).

• You have lawful access to the deceased’s remains, medical records, or other materials necessary to fulfill the requested service.

3. Scheduling & Payment

When you schedule a service, you also agree to:

• Provide true, complete, and accurate information at all times.

• Not use our services for any unlawful, deceptive, or malicious purpose.

• Sign all necessary service agreements or consent forms, as required.

• Pay full or partial fees in advance, depending on the service.

• Indemnify and hold EPIARX™ harmless for any claims resulting from a breach of these responsibilities.

We accept payment via major credit cards and authorized third-party processors. Services are non-refundable once rendered, except where prohibited by law.

Electronic Communications

By using our services, you consent to receive communications from EPIARX™ electronically, including service confirmations, reports, and notices. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

Record Retention

EPIARX™ retains records related to autopsies, consultations, and DNA services in accordance with internal protocols and applicable laws. DNA samples collected under the CircoGen™ service will be preserved according to the client’s selected storage plan. You may request a copy of your report at any time, subject to identification and verification procedures.

Force Majure

EPIARX™ shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, government restrictions, natural disasters, pandemics, labor strikes, transportation delays, or failures of third-party service providers.

4. Medical and Legal Disclaimer

All services and information provided by EPIARX™ are for informational and diagnostic purposes only. We do not provide legal representation, therapy, or ongoing medical treatment.

Our reports may inform decisions made by medical providers, legal representatives, or insurance agents, but we do not guarantee how they will be interpreted or used.

5. Privacy and Data Use

Required Statement:
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We collect only the minimum data required to deliver our services (e.g., name, email, phone number for scheduling). We never use SMS or phone numbers for promotional purposes.

6. Intellectual Property

All content on this website, including the EPIARX™ name, logo, written materials, and service marks (e.g., CircoGen™, Arts Memorial™), is the intellectual property of EPIARX Diagnostics™ or licensed appropriately. You may not copy, distribute, modify, or commercially exploit our content without written permission. Any unauthorized use may result in legal action.

7. Limitation of Liability

To the maximum extent permitted by law, EPIARX™ shall not be liable for:

• Indirect or incidental damages

• Delays in service due to third-party funeral homes or facilities

• Decisions made based on test results or autopsy reports

Our total liability in connection with any claim shall not exceed the total fees paid for the services in question.

8. Termination

We reserve the right to refuse or cancel services if:

• Legal authority cannot be confirmed

• Remains are not accessible in time to complete the service

• There is a conflict of interest or breach of contract

9. Dispute Resolution

These Terms are governed by the laws of the District of Columbia. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Washington, D.C.

10. Changes to These Terms

We may update these Terms periodically. The most current version will always be available at www.epiarx.com/terms. Continued use of our services indicates acceptance of updated terms.
